As you may be aware, yesterday, a Nassau County Supreme Court judge issued a ruling that the current statewide mandate ordering students and staff to wear masks in schools is unconstitutional and cannot be enforced.
 
This evening, the Appellate Division, Second Department granted an application by the Department of Health and the Governor’s office, staying the decision of the Supreme Court judge pending further proceedings. Following that decision, the Commissioner of Education issued a statement to school districts advising of the Appellate Division decision and stating that as a result of this decision, “the mask mandate remains in effect for schools across the state.”
